The order describes “birth tourism” as a practice where operators allegedly use deceptive advertising and inducements to bring foreign nationals to the U.S. for giving birth, including promises of citizenship and access to public benefits. It also says some operators coach travelers to misrepresent the purpose and length of their trip to consular and border officials.
The order directs the Secretary of State and the Secretary of Homeland Security to implement the policy. It says they may issue or adopt rules, policies, operational guidance, or other guidance to carry out the order, including steps meant to ensure each temporary visa category is used only for its intended purpose.
The order also frames the issue as an enforcement and national security concern, saying these schemes divert consular and enforcement resources away from legitimate visa applicants and undermine confidence in immigration law enforcement.
