No Borders NewsThe Executive Office for Immigration Review (EOIR) published an interim final rule in the Federal Register on February 6, 2026 titled “Appellate Procedures for the Board of Immigration Appeals.” The original deadline for written public comments was March 9, 2026.
EOIR has now issued a Federal Register notice extending that comment period. Written comments that were previously due March 9 are now due April 8, 2026.
This change affects the public’s opportunity to weigh in on how the BIA’s appellate procedures may be implemented or revised. It does not, by itself, describe a change to individual case outcomes, but public comments can influence how the rule is finalized.
