DHS has announced inflationary adjustments for two immigration enforcement-related fees required under HR-1. The law directs DHS to update certain fees each year based on inflation.
For fiscal year 2027, DHS set the adjusted fee for people ordered removed in absentia who are later arrested at $5,300. DHS also set the adjusted fee for “inadmissible aliens apprehended between ports of entry” at $5,300.
DHS says it will begin assessing and collecting these new fee amounts on October 16, 2026. The announcement is published as a Federal Register notice.
These fees are tied to specific enforcement situations described in the notice, so the impact depends on an individual’s circumstances. If you are affected, it may be important to review the official notice for the exact categories DHS lists.
This is not legal advice. For questions about how fees could apply in a particular case, consider contacting a qualified immigration legal service or reviewing the Federal Register posting.
